The bankruptcy petition filing results in an automatic stay being issued by the court which requires that all collection and other activities are halted. Chapter 7 Bankruptcy

Chapter 7 Bankruptcy is a way to eliminate all or part of your debt and provide a fresh start. If you cannot cover all of your bills each month, struggle with high credit card debt and the minimum payments required, have high late fees/interest payments on debt, calls from creditors, potential foreclosure on your home or repossession of a vehicle, a Chapter 7 filing could be the right thing for you. A Chapter 7 filing requires a means test that is based on income which must be passed to qualify.

The law recognizes a goal of being able to continue with the essentials of living when a Chapter 7 filing is made and has a list of exemptions to support this. In Georgia, if you own a home you may be able to stay in the home and protect a specific amount of equity. The same applies to one vehicle. An attorney will determine your situation regarding these exemptions. There are also small levels of exemptions for household items, jewelry, and tools of the trade. Everything else (non-exempt assets) will be liquidated and the money paid to creditors.

In the majority of cases, retirement accounts are fully exempt and protected in a Chapter 7 filing. However, child support, alimony, student loans, and most taxes are not exempt and will still be owed after a Chapter 7 filing is made. Dozier Law, P.C. Chapter 13 Wage Earners Reorganization

A Chapter 13 Wage Earners Reorganization is for people who have consistent, ongoing income, but the debt and the required payments on this debt have become too much. A payment plan is needed to deal with the financial challenges. Under Chapter 13 Reorganization, a plan involving monthly payments to a plan trustee is developed and filed with a bankruptcy court.

The Chapter 13 payment plan covers a 3 to 5 year period. In most cases, you will pay off part of your debt during the plan period and the debt remaining at the end of the plan is discharged as outlined in the plan. You do not have to liquidate any assets under a Chapter 13 plan. You keep your house, your vehicles, and all personal and household assets as well as savings and retirement plans.

In order to qualify for a Chapter 13 Reorganization you need to be employed, with a high likelihood of continuing to be employed through the plan period. This income supports the ability to pay the monthly plan amount and continue these payments to completion. When the plan period is over, the remaining eligible debt will be discharged as outlined in the plan. This includes things such as medical bills, credit card balances, and personal loans.
